A man (Gideon) crashed into Bay Harbor’s pool room and stole money, wine, and beer. Gideon was brought to court and he was found guilty and had to spend 5 years in jail. When he was in jail he thought that it was unfair that he was not given a lawyer during the court session.
This case occurred on June 3, 1961 in Panama City, Florida. The way this case was brought to court was Gideon kept asking to be released out of jail because he said he wasn't suppose to be in jail but the jail would not let him out so Gideon decided to write a habeas corpus petition and send it to the Supreme Court of the United States. When the court read what Gideon had written, the Court agreed to hear his case. This case was being brought to court because Gideon said that he lacked a defense attorney at the time of the trial and according to the sixth amendment every person has a right to an attorney for trial. Gideon said that this violated his constitutional right because he was not given an attorney.
